Definitions

  • Huiskees: Huiskees, established in Breda, the Netherlands, registered with the Dutch Chamber of Commerce (KVK) under number: 91194199.

  • Customer: the party with whom Huiskees has entered into an agreement.

  • Parties: Huiskees and the Customer together.

  • Consumer: a Customer who is an individual acting in a private capacity (non-commercial).

Applicability of General Terms and Conditions

  1. These terms and conditions apply to all offers, orders, agreements, and deliveries of products by or on behalf of Huiskees.

  2. Parties can only deviate from these terms and conditions if they have explicitly agreed to do so in writing (including electronically).

  3. Parties explicitly exclude the applicability of any additional and/or deviating general terms and conditions of the Customer or third parties.

Offers & Orders

  1. All offers on the Huiskees website are free of obligation and apply while stocks last.

  2. An agreement is concluded at the moment the Customer has fully completed the checkout process on the website and has received an order confirmation via e-mail.

  3. Huiskees reserves the right to refuse orders with due substantiation or to attach special conditions to the delivery.

Prices

  1. All prices applied by Huiskees are in euros (€), include VAT, and exclude any shipping or transport costs, unless explicitly stated otherwise.

  2. Huiskees may change the prices on its website at any time. Price increases after the conclusion of the agreement will not be passed on, unless they are the result of statutory regulations (such as a VAT increase).

Payments

  1. Orders placed via the webshop are paid for directly online using the offered payment methods (such as iDEAL or credit card), unless parties have explicitly agreed otherwise in writing.

  2. If payment after delivery has been agreed upon, a strict payment term of 14 days after delivery applies. If this term is exceeded, the Customer is legally in default without any further notice of default being required.

  3. In the event of default by a commercial customer (B2B), a contractual interest rate of 2% per month is due. For consumers, the statutory interest rate will be charged in the event of default. Any (extrajudicial) collection costs will be calculated in accordance with the applicable Dutch legislation (Besluit vergoeding voor buitengerechtelijke incassokosten).

Right of Withdrawal (Returns)

  1. A Consumer may dissolve a purchase during a cooling-off period of 14 days after receipt without giving any reason.

  2. The right of withdrawal does not apply to items made specifically at the request of the Customer in non-standard sizes or with specific, unique fabric or finish combinations (custom-made/made-to-order products).

  3. The Consumer must hand over the return shipment to the carrier within 14 days after registering the return.

  4. Products can only be returned if they are in their original, undamaged condition and feature the original, unbroken Huiskees security seal (hangtag). Damage or clear signs of use may lead to a reduction in value or rejection of the return.

Return Costs & Adjustments

  1. The costs for the return shipment are borne by the Customer.

  2. Huiskees applies a flexible return contribution based on the actual shipping costs charged by PostNL. These costs are passed on one-on-one per box and processed manually during the refund, as further specified in the online return policy.

  3. If the Consumer returns the entire order timely and correctly, Huiskees will refund the purchase amount minus the actual return costs within 10 business days after receiving the return shipment, via the original payment method.

  4. Any bundle discounts or volume discounts received will lapse if the remaining (retained) items no longer meet the original promotional conditions. In that case, the refund will be adjusted based on the individual retail price of the retained product.

Retention of Title

  1. Huiskees remains the owner of all delivered products until the Customer has fully complied with all their payment obligations.

  2. As long as ownership has not transferred, the Customer may not pledge, sell, or otherwise encumber the products.

Delivery & Delivery Time

  1. Delivery times stated by Huiskees are indicative. The delivery time commences as soon as the order has been successfully placed and paid for.

  2. Exceeding the indicative delivery time does not entitle the Customer to compensation. Consumers retain their statutory right to dissolve the agreement free of charge in the event of an excessive delay (longer than 30 days, unless agreed otherwise).

  3. The risk of loss, damage, or theft of the products transfers to the Customer at the moment they are physically delivered to the Customer or to a third party designated by the Customer (such as neighbors).

Warranty & Complaints

  1. Huiskees guarantees the soundness of its handmade products. The warranty applies exclusively to material, manufacturing, or construction defects and does not apply to normal wear and tear, improper use, or lack of maintenance.

  2. The Customer must inspect the delivered products as soon as possible after receipt. Any defects must be reported in writing via service@huiskees.com within 2 months of discovery by a Consumer. For commercial customers (B2B), a term of 8 days after delivery applies.

  3. Consumers in the EU can also file complaints via the European Commission's ODR platform at http://ec.europa.eu/odr.

Liability

  1. Huiskees is only liable for damage suffered by the Customer if and to the extent that this damage was caused by intent or deliberate recklessness on the part of Huiskees.

  2. Huiskees is solely liable for direct damage and is never liable for indirect damage (such as consequential damage or lost profits).

  3. The liability of Huiskees is at all times limited to a maximum of the invoice amount of the relevant order, or at least to the amount paid out by the liability insurance of Huiskees in the specific case.

  4. All images, sizes, and colors on the website are indicative. Small deviations (inherent to handmade products and natural fabrics) cannot constitute grounds for compensation or dissolution of the agreement.

Force Majeure

  1. Huiskees is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure. Force majeure includes, but is not limited to: extreme weather conditions, transport obstructions, strikes, government measures, as well as defaults or disruptions on the part of suppliers and delivery services.

  2. If the force majeure situation lasts longer than 30 calendar days, both parties have the right to dissolve the agreement in writing, without any obligation to pay compensation.

Amendment of General Terms and Conditions

  1. Huiskees is entitled to amend these general terms and conditions. Amendments will only take effect after they have been published on the website.

Applicable Law & Competent Court

  1. Every agreement between the parties is exclusively governed by Dutch law.

  2. Disputes will be submitted exclusively to the competent court in the district where Huiskees is established, unless the law imperatively prescribes otherwise.
